Benefits of Amnesty

Students or Student Organizations (SO) who seek emergency assistance on behalf of persons experiencing drug or alcohol-related emergencies, as well as the student experiencing the emergency, are eligible to receive Amnesty.

Being granted Amnesty means that the incident is not reportable on a student conduct record and students granted with Amnesty will not incur any financial costs to complete educational interventions associated with being granted Amnesty.

Contact 911, UKPD, or University Staff to get them help.

Remain with the person until help arrives.

Amnesty Eligibility

Amnesty is considered when at least one of the following occurs:

  • One Person Calls for Another
    • If a student calls for medical attention for another individual intoxicated due to alcohol or drugs they must complete the following three (3) responsible actions in order to receive amnesty:
      • Call 911 or UKPD
      • Stay with the individual needing assistance until emergency services arrive
      • Cooperate with University officials, law enforcement, and emergency officials.
  • EMS Responds
    • If EMS evaluates a student for alcohol and/or intoxication, the evaluated student is eligible for amnesty.
      • This is a possibility regardless if the student goes to the hospital or not.
  • A Student is Transported
    • If a student is transported to the hospital for an emergency related to alcohol and/or drug intoxication they are eligible for amnesty.
      • The student MUST be transported by EMS or with a directive from EMS.
      • EMS, UKPD, or another law enforcement agency MUST be called for a student to be eligible to receive amnesty.

Types of Amnesty

The following are the types of Amnesty that students may receive:

Bystander Amnesty

When a student calls for help for another individual who needs medical assistance due to Alcohol and/or drug intoxication, the student who called for help is typically granted Amnesty as a Bystander.

With Bystander Amnesty, the student who called for help will normally receive a letter from the Office of Student Conduct thanking them for getting help for the other individual, and inviting the student to meet; however, a meeting for this individual is not required.

Conditional Amnesty

When a student is the individual who required medical attention due to alcohol and/or drug intoxication, they are normally going to be invited to meet with the Office of Student Conduct in order to discuss the situation in more detail.

In this meeting, the student will have the opportunity to share their perspective of the situation as well as have a discussion of their personal substance-use history. Together with a Conduct Officer, an Educational Intervention Plan (EIP) will be created with the student. The EIP typically focuses on substance-use education and some sort of reflective opportunities.

With being assigned an EIP - the student will be granted with "Conditional Amnesty" which is in place until the EIP is fully completed.

Full Amnesty Granted

Once a student who required medical attention completes their EIP, they are granted with Full Amnesty. Typically this student will receive outreach from the Office of Student Conduct thanking them for completing their EIP and informing them that they have been granted with Full Amnesty.

At this time the situation is considered to be closed, and is not maintained in a reportable student conduct record.
