How Do Military Benefits/Status Impact Residency for Military Members, Veterans & Dependents?

Pursuant to 13 KAR 2:045

Section 7. Member or Former Member of Armed Forces of the United States, Spouse and Dependents; Effect on a Determination of Residency Status.

(1) A member, spouse, or dependent of a member whose domicile and residency was Kentucky when inducted into the Armed Forces of the United States, and who maintains Kentucky as home of record and permanent address, shall be entitled to Kentucky residency status: (a) During the member's time of active service; or (b) If the member returns to this state within six (6) months of the date of the member's discharge from active duty.

(2)(a) A member of the armed services on active duty for more than thirty (30) days and who has a permanent duty station in Kentucky shall be classified as a Kentucky resident and shall be entitled to in-state tuition, as shall the spouse or a dependent child of the member. (b) A member, spouse, or dependent of a member shall not lose Kentucky residency status if the member is transferred on military orders while the member, spouse, or dependent requesting the status is in continuous enrollment at the degree level in which currently enrolled.

(3) Membership in the National Guard or civilian employment at a military base alone shall not qualify a person for Kentucky residency status under the provisions of subsections (1) and (2) of this section. If a member of the Kentucky National Guard is on active duty status for a period of not less than thirty (30) days, the member shall be considered a Kentucky resident, as shall the spouse or a dependent child of the member.

(4) A person eligible for benefits under the federal Post-9/11 Veterans Educational Assistance Act of 2008, 38 U.S.C. 3301-3325, or any other educational benefits provided under Title 38 of the United States Code shall be entitled to Kentucky resident status for purposes of tuition charged at state-supported institutions.

(5) A person's residency status established pursuant to this section shall be reassessed if the qualifying condition is terminated. 

NOTE: Questions concerning the federal Post-9/11 Veterans Educational Assistance Act of 2008, 38 U.S.C. 3301-3325, or any other educational benefits provided under Title 38 of the United States Code should be directed to the Veterans Resource Center - (859) 257-1148.  

When is Residency Status Reassessed?

Residency status is re-assessed any time there is a break in enrollment or a change in degree level.

What is UK's Military Leave Policy?

5.2.5.2.3.2 Excused absences for military duties

If a student is required to be absent for one-fifth or less of the required course interactions (e.g., class meetings) due to military duties, the following procedure shall apply:

1. Once a student is aware of a call to duty, the student shall provide a copy of the military orders to the Director of the Veterans Resource Center. The student shall also provide the Director with a list of his/her courses and instructors.

2. The Director will verify the orders with the appropriate military authority, and on behalf of the military student, notify each Instructor of Record via Department Letterhead as to the known extent of the absence.

3. The Instructor of Record shall not penalize the student’s absence in any way and shall provide accommodations and timeframes so that the student can make up missed assignments, quizzes, and tests in a mutually agreed upon manner.

What is UK's Readmission Policy for Military Students?

A student is eligible for readmission if, during an absence, the student performs uniformed service, voluntary or involuntary, in the Armed Forces, including the National Guard or Reserve, active duty, active duty for training or full-time National Guard (under federal authority). The cumulative length of all absences for uniformed service (service time only) must not exceed five years. 

A student must provide orders, or written notice by Commanding Officer, of a Uniformed Service Obligation, such as Temporary Duty (TDY), etc., to the Office of the Registrar as far in advance as possible, unless precluded by military necessity. Such notice does not need to indicate when the student will return to the University.  The student must also give oral or written notice of Intent to Return to the University of Kentucky within three years after the completion of the period of service. Immediately upon the student's return to school, the student must provide notice that he/she may be entitled to the tuition and enrollment benefits outlined in this policy.  The student is required to provide official military obligation documentation to the Office of the Registrar and or Veterans Resource Center. 

A returning student will be charged the same tuition and fees in effect during the last academic year the student attended, unless veterans' education benefits or other service member education benefits will pay the amount in excess. For subsequent academic years, the returning student may not be charged tuition and fees in excess of what other students in the program are charged. 

A returning student will be readmitted into the same academic program the student was enrolled in prior to the military service obligation. If the exact program no longer exists, the student will be admitted to the program that is most similar, unless the student requests or agrees to admission to a different program. Returning students will be re-enrolled with the same enrollment status, number of completed credit hours, and academic standing as the last academic year of attendance. 

Are You a Student that Has Received Military Orders or has Military Drill Dates During Class?

As soon as you are notified that you will be receiving military orders, notify the VRC at VetCenter@uky.edu with a copy of your orders attached.

If you are a student in the Guard or Reserves and have drill/training dates that will impact class attendance email the VRC at VetCenter@uky.edu with a copy of your military drill schedule.

How Do I Transfer my Post-9/11 GI Bill to A Dependent?

My Student is using a VA Benefit, What is the Process to Change their Residency Status to an In-State Status?

If your student is using a VA education benefit they will receive the in-state tuition rate here at UK.  

For the students residency status to change, they will need to email a copy of their VA Certificate of Eligibility to the VRC at VetCenter@uky.edu
